Do you really think this is a good idea? My concern is the precedent it could create. If universities can be held legally responsible when violence occurs at controversial campus events, schools may become far more reluctant to host open debates, political speakers, or organizations that attract protests and security concerns. And let’s be realistic: this could especially make things harder for conservative organizations, which already often face significant resistance, protests, and administrative hurdles when trying to hold events on college campuses. If universities now have to worry about being sued whenever security fails or violence breaks out, the easiest response may simply be to avoid hosting controversial conservative speakers altogether. Accountability for genuine negligence is one thing. But we also have to consider the unintended consequence: creating an environment where universities become even more risk-averse and open debate becomes even harder to maintain.

Once and for all, this should settle the problem of security on campuses. Univ police need to call local and state authorities when groups take over. If the liberals are secure, the conservatives should be secure. Any credible person should be able to speak on any publicly owned campus and there should be no takeovers. Win or loose, hopefully the threat will do what fickled and partisan lawmakers won’t do. Sadly we have to go to the courts once again.
